INTRODUCTION
Welcome to the Well Protected Eyewear website (hereinafter: the “Site” and the “Merchant”).
We kindly ask you to carefully read the following terms and conditions, they bind you with us, owner of the Site. In addition, you accept by the same token the mode of electronic communication with us for all of your exchanges and that these meet all the requirements of written communication. We reserve our sole discretion to refuse to serve you, to cancel an order, to close your account, to delete or modify the content of the Site or to cancel an order whether or not you have complied with these Terms and Conditions. 1. CONFIDENTIALITY OF PERSONAL INFORMATION
Please see our privacy policy available at the bottom of our site to learn about the ways in which we collect, share and manage your personal information.
2. GENERAL
The products and services offered are intended to be sold to adults. If you have not reached the age of majority at your place of residence, you can only place an online order with the participation of your parents or guardians.
3. ACCURACY OF INFORMATION
We do everything in our power to ensure that all information published on our Site is error-free, but we cannot guarantee this fact. We may refuse or cancel an order containing an item with an incorrect description or price. Unless otherwise stated, prices are quoted in Canadian currency. The products offered on our Site as well as the dates of offers, prices and availability, characteristics and technical specifications of these products are subject to revision and change without notice. It is possible that a product ordered online is no longer available in our inventory or that it cannot be delivered due to a situation beyond our control. We will then proceed to cancel the order and refund the sums paid in return, if this is the case. Your only recourse in the event of non-conformity of the description of a product is to return it in its original packaging for refund, in accordance with the refund provisions which apply below.
4. REGISTRATION AND PASSWORD
You will need to complete a registration form to access certain parts and features of the Site. You agree to provide us with up-to-date and truthful information and to keep this information up to date at all times. You agree to protect the confidentiality of your user name and password as well as access to your computer, so that no other person uses it. You are responsible for all transactions made in your account using this information. You must immediately notify us of any unauthorized use of your username and password and any breach of security of which you become aware, and within twenty-four (24) hours of becoming aware of such situation.
5. COMMENTS
You have the option of posting comments and criticisms relating to the content of the Site. You are fully responsible for the comments you post, we are not responsible for them and you agree to indemnify us against any damages arising from them. It is prohibited to make statements on behalf of others, to hide your identity or to make statements that are unlawful, obscene, threatening, defamatory or infringing on the privacy or intellectual property of any person or constitute chains letter, direct mail or spam. We reserve the right, but have no obligation, to edit or remove comments without explanation, and we assume no responsibility for systematic review of any postings. When you post a comment, you grant us the non-exclusive, royalty-free, perpetual, irrevocable right to use the name and posted content, to reproduce, modify, adapt, publish, perform, translate it, distribute it, communicate it to the public and display it anywhere in the world and on any medium. We ask that you post only one review per product, unless you wish to add new information. You agree to only comment on products that you have personally tried, maintaining a respectful tone at all times. Employees and competitors of distributors and manufacturers are prohibited from posting comments.
6. APPLICABLE LAWS
These terms and conditions are governed by the laws of the state of Quintana Roo or the country of Mexico applicable thereto. In addition, any legal recourse against the Merchant must be brought before the judicial district of Quintana Roo.
7. ORDERS
7.1 ORDER ERRORS
In the event that you believe that an error has occurred when placing an order, we invite you to notify us without delay, but at the latest within 24 hours of the delivery (based on the courrier timestamp) by sending us a message at the following address [email protected] or via the contact form on the website and indicating to us in sufficient detail the error that has been made.
7.2 DELIVERY AND RETURNS
Unless you have chosen a specific carrier and delivery time during the transaction for which additional charges may apply, the delivery method and carrier will be determined by Well Protected and our usual delivery times. We undertake to deliver your purchases to you within a reasonable time subject to the availability of the carriers used by the sender, who are solely responsible for the delivery of the products or services purchased. Risk of loss and title to the purchased good or service pass to you when it is handed over to the carrier or if the goods cross an international border, such risk passes to you after customs clearance. In-store pickup of an online purchase must be made during normal business hours. In this case, the risk of loss and the right of ownership of the goods purchased pass to you when you take possession of them at the store. Also, the usage of a promo or discount code is not applicable with the free shipping. Free Shipping policy only applies on regular price orders.
7.3 CANCELLATION, EXCHANGE, TERMINATION, RETURN, EXCHANGE AND REFUND POLICY
Cancellations of correct and error-free orders are not permitted.
There is no exchanges allowed.
If you receive a defective or broken accessory, we will replace it free of charge, except if the damage occurs during shipping. In this situation, you will need to open a claim with the carrier to obtain a refund from them. In the case the damage happened during the creation process, we will provide you with a prepaid return label, and you must send the defective item back to us within a 7-day timeframe. You must send us a picture of the shipping box and a description (with pictures or video) of the damage/malfunction to [email protected] to obtain an RMA number.
All sales are FINAL, and no refunds will be issued under any circumstances. For custom-made orders, such as bracelets, necklaces, body chains, etc., you are responsible for providing accurate measurements. We will create the product according to the provided measurements. If it does not fit properly and was made according to the provided measurements, there will be no exchange, refund, or replacement. This policy also applies to all accessories that require a measurement choice, such as rings. You also understand and accept that you will be responsible for paying the total amount of the order, even if you open a claim with PayPal or your credit card issuer. In such cases, you will be held responsible for all additional fees, and we may refer the debt to a financial recovery agency.
The only applicable warranty on the item is valid for 24 hours after the reception of the parcel, according to the carrier’s delivery timestamp. If the buyer does not declare any damage or issues within this period, there will be no refund, exchange, or replacement of the items.

8. DISCLAIMER OF WARRANTY
SUBJECT TO APPLICABLE LAW, WELL PROTECTED EYEWEAR DISCLAIMS ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED AS TO TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE PRODUCTS AND SERVICES SOLD ON THE SITE. IT ALSO EXCLUDES ANY WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, IN THE CONTENT, MATERIALS, PRODUCTS OR OTHER SERVICES INCLUDED ON OR THROUGH THE SITE AND ON ITS SERVERS AND ELECTRONIC COMMUNICATIONS.
9. LIMITATION OF LIABILITY
WELL PROTECTED EYEWEAR SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR INDIRECT DAMAGES, RESULTING FROM THE USE OR MISUSE OF THE SITE OR FOR THE PURCHASE OF GOODS ON IT, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSSES FOR PROFIT, USE OF DATA OR OTHER INTANGIBLES, EVEN IF MERCHANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. COPYRIGHT
The copyrights and Trademarks contained in the information published on the Site are protected by the laws relating to intellectual property and are made available on the Site by the granting of a specific license in this regard. In accordance with the laws relating to intellectual property in force, it is prohibited to use, display or exhibit any trademark, copyright or any other protected work accessible on the Site for any reason other than to proceed to the sale of these products and services without the right to grant sublicenses to third parties. The owners of the marks appearing on the Site retain all rights not expressly granted in these Terms and Conditions. If you have reason to believe that violations of the terms and conditions have been committed or if your work has been copied or is exploited on our Site in a way that infringes your intellectual property rights, please inform us as soon as possible by sending us a message to the following address [email protected] indicating in sufficient detail the breach that has been committed.
